Understanding Libel in New York
Where a person is defamed in writing, it is called libel. Libel also includes false business reviews published on websites such as Yelp, Trip Advisor, and other similar “gripe” websites. Libel is considered more serious than slander because it is more likely to reach a wider audience.
The elements of libel in New York are:
- a false and defamatory written statement of fact;
- regarding the plaintiff;
- published (writing) to a third party;
- which injures the plaintiff.
